Matthew Stock, 54, is serving an 18-year to life sentence in the Sterling Correctional Facility after being convicted of sexually assaulting one child and acquitted of sexually assaulting a different child. He was deemed by the court to be a habitual child sex offender because he was on parole for a previous sexual assault on a child conviction. In his appeal, Stock contended that the court improperly allowed the playing of a forensic interview with one of the children during the trial. The child hearsay statute, which Stock cited in his appeal, has an exception for child victims of sexual assault, according to the appeals court. Also, according to the appeals court, the victim testified during the trial, and the testimony matched the information in the forensic interview. Stock has failed to meet his burden to demonstrate how the order in which the evidence was presented impacted the fundamental fairness of his trial, the appeals court wrote in an unpublished opinion (meaning it did not set a precedent) Thursday. Stock also contended the court should not have allowed the testimony of an expert witness who opined on the victims credibility and bolstered the credibility of the investigator on the case. The appeals court ruled that the defense did not object to the testimony during the trial, and so the testimony was admissible. Stock also argued his sentence was disproportionate to the nature of the offense, but the appeals court disagreed, saying child sex assault as a charge is per se grave and serious. Considering Stocks predicate and triggering offenses in combination, we conclude that they are not so lacking in gravity or seriousness that a sentence of eighteen years to life for the triggering offense is grossly disproportionate. the appeals court wrote. Stock is in the middle of a federal lawsuit against the Mesa County Commissioners alleging he was mistreated while in custody in the Mesa County Detention Facility. A paraplegic, Stock has accused the county of violating the Americans with Disabilities Act after suffering a spinal cord injury in a cell that did not have safety bars. Stock was already a paraplegic when he was booked in to the jail, according to the lawsuit, and originally was placed in a cell that did have safety bars. However, he was moved to a different cell without safety bars as punishment for allegedly stealing a piece of cake from another inmate (Stock has said the other inmate gave him the cake), and experienced a second spinal cord injury while transferring himself from his wheelchair to the toilet.
