They can't do that, the doctrine is "multi-mode competition", which _was_ the test for healthy markets -- and unless things have changed, that's what exists today. I'm not a fan of "multi-mode competition." It was stupid, and responsible for the kinds of duopoly and monopoly markets that exist, but that's what the FCC adopted -- so a market's competition is "healthy" if you have (say) a satellite ISP, an incumbent telco, and incumbent cable company, and maybe even power line Internet, which was considered.
