There is no delegated power to create transfer payments from one person to another person through either appropriations or tax law. And here's the Constitutional clause that makes it UNCONSTITUTIONAL. *Amendment XIII* Section 1. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, *to pay the Debts and provide for* the common Defence and *general Welfare of the United States* ... It does NOT say the GENERAL WELFARE OF *THE PEOPLE* . *Amendment X* The *powers not delegated to the United States* by the Constitution, nor prohibited by it to the States, *are reserved* to the States respectively, *or* to the people. And as per Amendment 10 where it says *or* "to the people" it means that the PEOPLE are NOT the States *or* THE United States... the people are a seperate entity and Article I Section 8. says *general Welfare of the* *United States* so there is/was no delegated power for the United States to make TRANSFER PAYMENTS from one person to another via tax laws or appropriations laws.
