It is highly likely so that one or more of the cameras would have recorded the brandishment of a gun had Pretti done such a thing, but the null hypothesis is that he did *not*. That holds without support unless shown to be false. Where it gets tricky is that the burden reverses when the agent is charged with a crime. Now, the assumption is that the agent could not have feared for his life, and I can't say that's so. What disturbs me is that we tend to jump to easy interpretations in a very complicated environment. Best, IMHO, to get ICE out of there. It's obviously not going to have a happy ending!
