3.2, ErrorDocument, and logging

I'm using Mod_layout 3.2 and apache 1.3.27 .  I'm using a custom error
document:

ErrorDocument 404 /cgi-bin/guardian.pl?404

The header and footer of the page are being dynamically generated by
mod_layout.  The problem that I'm running into is that the apache logs
generate a 200 response code for pages that should be generating 404
response codes.  I've narrowed it down to definitely being a problem with
mod_layout.  If I move the script to a directory not being affected by
mod_layout, and I request an invalid document, I get error 404 in the log
files.
