Chances are that you do unless you have some written statement from Apple
that they are OK with it.

Apple own the rights and they have decided not to make it available anymore.
Also it wasn't a free program to begin with, it became one while Emagic was
already owned by Apple. No matter how you feel about the whole Emagic
thing, it doesn't change the fact that Apple can do with it as they please.

Make yourself heard at Apple. If enough people still care and knock at
their door, they might re-instate the download possibility in one way or the
other.
