My understanding, with the usual caveats regarding no real legal knowledge on this, is that providing the binaries are not being hosted and distributed for commercial gain then the patent holders will ignore you. That has certainly been our experience at Rarewares over the last 10+ years. I believe they are only interested on those making money from the encoder/decoder. I'm not certain what the strict legal position is, but that has been our experience. Hope that helps.
