I've just spent the morning trying to figure out why I was getting this 
issue. 
If you look at the image I've attached you can see that there are five 
'products' returned in the query filtered by 'brand' but the scope also 
returns that the total count as 16 and hence 2 pages. Once you clicked to 
page 2 of the list nothing was returned and the only way back was to change 
or removed the filter and go back to page 1 again. 
The 16 ended up being made up of draft versions of products that had the 
correct 'brand' but whose approved version had a different 'band'.

My fix above stops the filter throwing a '' could not be converted to a 
boolean error. 
But I wonder if there need to be some change to the way the 
formtools.getRecordset() works so that it lists the draft pages correctly.
