It's open source David. Meaning you can do whatever you want with it.

The only thing you need to ask permission for, as with anything else, is 
to use the name of the project (SwiXML in this case) in the promotion of 
your code.  You can claim your project uses SwiXML you just can't claim 
it IS swixml or that it's SwiXML approved or anything like that.
