I don't remember anyone saying that, but I may well have missed it. 
Various people *have* claimed that a copy of z/OS or OS/390 
licensed for a particular z/Series or S/390 processor remains valid 
when run under Hercules on that same box. Certainly the handful of 
IBM OS licences I have ever read in detail support that view, 
simply because they make no mention of anything like Herc. The 
additional ADCD Ts & Cs (as updated last year) suggest the 
opposite, because they do use a phrase along the lines of "...any 
other emulator" as an exclusion. But even they can be read as 
merely excluding running the ADCD on a box not explicitly licensed. 
Perhaps Herc under Flex/ES is fine.
