   "I" assUme that "I" can legally run OS/390
under Hercules.  For even older software, at
one time we purchased software from IBM.
There was never any trouble transferring
licenses to new systems.  Transferring
"purchased" licenses to a PC should be easy.

   Back to my first statement.  I run OS/390
2.4.0.  The reason it's so old is because we
have been trying to shut the main frame down
since December 1994.  I really believe that
we may complete the shut down this year or
next.  My OS/390 system runs under the
Flex-ES emulator under SCO Unixware 7 on
an IBM x232 PC.  When SCO had issues, the
Flex-ES reseller planned to switch SCO to
Linux.  Apparently there was no licensing
issue?  If I can switch the base operating
system I see no reason that I could not
switch emulators from the high performance
Flex-ES to the high portable Hercules.
Users would scream and nightly back ups
would take a week but it may be legal as
far as IBM is concerned?  I might run afoul
of some Commonwealth statutes concerning
wasting resources but that is not an IBM
licensing issue.

for disaster recovery.  I assUme that IBM
would have approved if asked but I'm
shutting the system down not helping it
spread to new locations.

   I do have two MVS 3.8j systems at work
running under Hercules.  They are to allow
access to data after I get the main frame
shut down.  Some of our data has a legal
requirement to be available for access for
five years.  MVS 3.8j is one of the no-charge
operating systems that runs under Hercules
so IBM shouldn't have an issue.

   Why not define your case and present it
to IBM?  My dealings with IBM might not
match your dealings exactly.
