Seems to me that that is a very specific case.
Lots of people are running ZOS -Illegitamately
And IBM seems to be turning a blind eye to that...
 
As long as Hercules is a poor mans mainframe ( Free) IBM is not going to
help you.
And as long as it's a bunch of "Crazies" spending their time they are not
going to bother fighting you.
 
I think it's when we try to Commercialize that we are running into problems.
Perhaps a better way to go would be to try to cooperate with IBM - Software
- Hardware - any way we cld work with them instead of against them.
 
correct me if I am wrong, but I was always under the impression that IBM
sold a license to run their OS on a specific machine.
Had nothing to do with Hercules -- ALWAYS running it on other hardware was
taboo to some degree.
 
So - how did the other platforms resolve their issues.
What did AMDAHL do? what did FLEX do? Fujitsu etc. etc.

IBM seems to behaving very sanely in ignoring us --- I don't think we should
wait for their blessing.....
Lets just hope that they don't turn their full wrath on us.

Harold,

It's not so much about protecting invention but rather about achieving a 
result unobtainable by other means - specifically forcing IBM to recognize 
Hercules as a legitimate platform for running z/OS.

Ron is suggesting that the patent system could be used to gain some 
bargaining power which could succeed where the anti-trust route failed.

Unfortunately however the system is skewed in favor of the party with the 
deepest pockets.
