The US law is somewhat more tolerant of initial public disclosure prior to
applying for a patent, but is becoming less so under the recently enacted
=93America Invents Act=94 which substantially weakened (but did not elimina=
te)
the 1-year =93grace=94 period. Ideally, the Hercules developers should have=
 a
private forum in which to discuss new ideas confidentially before making
even the initial provisional patent application. That said, because the US
is a key market for IBM, a US-only patent filing may be sufficient for
Hercules=92 purposes. The risk of discussing an idea on a public forum like
this up to a year before filing the patent application, especially under th=
e
new US law that takes effect in March of 2013, is that someone else could
file first, and the burden of proof would be on the Hercules developer(s)
that it was derived from this forum. So filing in the UK would indeed be
futile if a disclosure has been made here, but not necessarily in the US if
it was less than a year ago.

Patents worldwide are structurally similar, and (I believe) follow the
original UK model. The UKIPO website, right on the 1st page, says "Before
you apply, there are two important issues you need to consider =96 the need=
 to
keep your invention secret and the importance of getting professional
advice". The invention must benew and something that can be evidenced. For
software, the idea must have a tangible "technical effect", else your paten=
t
attorney won't (or maybe shouldn't) even consider it.

If an invention has been discussed on this forum, there's no point donating
money to a Patents Attorney to buy his next car.

Costs can be =A31000 or maybe less if you do the work (UK) to submit the
patent (ie, up to Pat Pending), $2000 (US). Lots more money to spend later
on, especially if someone appears to infringe it.
