Those were the rules prior to the US becoming a signatory to the Berne Convention, which only happened in 1989. If you published something without a copyright notice, it was public domain. Post-Berne it is by default copyright and you instead need an explicit "release to the public domain" notice. MVS 3.8J was published before 1989 so IBM have given up all rights to the product. They can only copyright any changes they make to it, like the z/OS changes. BFN.
