The point is that you indeed had the choice to sell it yourself and since you didn't you would only suffer from your choice and only your choice. Fairness doesn't come into it, if you see it from that point of view. A copyright law that didn't support copyleft (and it is not entirely clear the current one does either) might be preferable for a number of reasons. Note that normal sale of copyrighted work almost wouldn't be effected at all even under such circumstances.
