Microsoft licenses for include files etc.?

Hi,

Wine project contains a lot of resources such as data structures in its include
file "include/winnt.h" or the general API knowledge in its .c implementations.

Unfortunately Micorosoft licenses are usually very restrictive for any possible
'redistribution' of their covered material. Where are those resources from if
they are legal at all? I would like to contribute to Wine but I am scared of
the possible law consequences.
