It looks pretty much identical to the Windows XP icon, and even if not a bitwise copy of it, it's still a copy for copyright purposes. The original logo clearly has sufficient creative content to attract copyright protection, and has no elements dictated by functional considerations. Use of this logo would therefore require a license from Microsoft. Is its planned use within a license granted by MS?
