You will be fine with this, it's effectively "non-selectable".  When someone clicks create, they will get the assignee field displayed if they have assign permission and the field won't be there if they do not.  If they don't have assign permission, then the system will follow the "automatic assignee" rules (people who do have "assign" permission will have the option of --automatic-- on the list)

It *can* be configured to block creation in some cases - if you start by setting assignee as "mandatory", it's possible to end up with a blockage, but it'll still go into the create screen, and tell the user why they can't raise it
