But that is not what your original posting was saying.
The OSCache developers are already aware of the fact that throwing an Exception for stale data is a bad idea. (http://forums.opensymphony.com/thread.jspa?threadID=3278&tstart=15)

However this comment is now 1 1/2 years old, I wonder when they will finally fix it. And when they fix it, it will break all client code, since that relies on an exception being thrown ...
