Not really it's more you have a different intrepetation of human rights. In 
Europe we call the rights "human", in the US you call them "citizen". The US 
has always had a tradition of disregarding the human rights of convicted 
criminals, and recently also suspected criminals. You even break the foremost 
important right of all: "The right to live, no man may decide whether another 
should live of die" when it comes to convicted black people.

Whether criminals and foreigners are covered by the "human" rigths or not is 
thus the most important schisme between US and EU.

Interestingly Europe has the same problem with Isreal. Influential danish jews 
tried to convince the danish media a year ago or so, that there were such a 
thing as acceptable torture. Noone bought it and the danish-isreali relations 
dropped even further.
