In most cases, OpenAL can be used for both commericial and non-commercial use without any fees/royalties. Creative Labs has an implementation for Windows. I can't remember their terms but LGPL comes to mind. But lots of commercial apps have shipped with theirs without fees. Creative also has an Xbox implementation...don't remember the terms for that either. OpenAL Soft is another implementation under the LGPL. Apple ships their own implementation with Mac and iOS.
