Speculation on why Apple did not continue their ZFS project and make it a part of OS X is the potential for legal repercussions and Sun/Oracle failure to stand behind and indemnify Apple.  Supposedly, Apple was willing to pay money to license ZFS, but wanted to be indemnified against IP claims from others, which Sun/Oracle were not willing to do.
