Go re-read the first amendment again, paying attention to the first five 
words.

Because businesses are allowed to state that they don't want to conduct 
business with individuals as long as it's a clear, documented, and legal 
reason.  The legal aspect is that there are a single digit (?) number of 
reasons that are illegal to use.  Businesses are free to refuse to 
conduct business with people wearing hats.  (Religious garbs excluded.)

definitely not Congress.
