This is where things get more nuanced.  You are free to talk about / 
discuss / pontificate "fire" with a group of people, even in a theater. 
However, you are not allowed to shout "fire" as if to incite people to 
panic.  The two vocalizations of "fire" have decidedly different 
meanings and intentions.  The former is legal.  The latter is not. 
Though the former is probably discouraged to avoid confusion as being 
the latter.

There is also the fact that laws regarding the latter are probably 
created at a much more local level and have nothing to do with Congress. 
  Then there is the issue of smaller, more regional, governing bodies 
being beholden to the same restrictions as Congress or not.
