I figured I would provide some feed back:

Running the following command I get a error when checking mtime.

$ dar -+ merge -A 0002 -@ 0003 -/ S
Error while saving data: Cannot get mtime: No such file or directory

I added some debug code and found it was looking for the mtime of <ROOT>.  Not 
sure why it is trying to look for mtime during a merge.

I commented out two lines in src/libdar/tools.cpp (1505, 1506) and tryed it 
again:

$ dar -+ merge -A 0002 -@ 0003 -/ S
<ROOT>/newfile from the first archive is about to be overwritten by same entry 
of the second archive, continue ? [return = OK | Esc = cancel]
Continuing...
Error while considering file <ROOT>/newfile : Subtracting a infinint greater 
than the first, infinint cannot be negative

 with 0 hard link(s) recorded
 0 inode(s) ignored (excluded by filters)
 0 inode(s) recorded as deleted

The error about 'infinint cannot be negative' seems to bomb the process 
because the resulting archive contains the file from archive 0002

 dar is part of the Disk ARchive suite (Release 2.4.0_dev)
