It's certainly a bit risky.

The only entity that can pay the renewal is the regsitrant. With a .com you
need "permission" or a "key" from the existing registrant to transfer a
domain you "own" to another registrant. This is what makes it hard to do if
the existing registrant has "disappeared" or doesn't want to release the
domain. A lot hinges on the existing registrant being willing to provide the
required "key" for a transfer to take place, once it has been transfered it
can be renewed but another problem is that any transfer may be blocked with
the renewal pending.

Proving "ownership" of the domain(s) with the registrar and showing
non-cooperation from the existing registrant should enable the registrar to
execute a transfer to their prefered registrant and once there, and the
domain renewed, it should be possible to transfer (again) to our preferred
registrant. Personally I'd not bother with the last step unless the next
renewal price was going to be silly or the service from the registrars
regsitrant was poor or unreliable on the net (not likely IMHO).
