I was too fast: I get the error only if I start dvips in the root of
a drive (in my case drive I:), inside a folder it works fine. 

Also I can't save a simple file in the root, so it is win xp which
forbits it (not miktex). But I don't know if it is new in win xp, I
never before tried to run/save anything in the root of a drive.
