Not on my machine. Not when I'm using an external repository. Then
uninstalling and reinstalling a package gets the newest version from
the repository.  

Regarding your API error: last time I heard from this on, it was due
to some open tool. Make sure that no miktex application (settings,
yap, pdflatex ...) is running in the background.
