The first item in the Acceptance clause is sufficient to bar this software from many distributions. While it is true that copyright applies to copying, the concept that the license is accepted by merely downloading the software from a server or loading from a CD is quite problematic. The clause basically makes downloading the software (perhaps not even being aware of doing it) is the same as signing a contract. Regardless, there is nothing to prevent people from downloading and enjoying the software.
