1) The XviD code is under GPL. Read the LICENSE file which is included 
with every archive as you sure have noticed.

2) XviD is an implementation of MPEG-4. Depending on your usage, you may 
have to pay license fees to MPEG-LA. Please contact them for the exact 
terms.
