I think you could fork Amaya, as long as you didn't continue to "market" it under that name: http://www.w3.org/Consortium/Legal/IPR-FAQ-20000620#Software However, I'm sceptical of the feasibility/desirability of maintaining a web engine just for an editor rather than reusing one of the mainstream web engines.
