<h1> tag can not be detected if choose "Instead of title and description" in the header at Layout Blogger?

Hi All,
I have a problem with <h1> tag on my blog 
(http://www.dewainside.blogspot.com)
The problem is <h1> tag can not be detected if i choose "*Instead of title 
and description*" in the header at Layout Blogger. But if i choose "*Behind 
title and description*" <h1> tag can be detected. So i choose "behind 
title" :( althought i want to use image on my header.

Here my HTML Template:

<!--Show the image only-->
      <div id='header-inner'>
        <h1><a expr:href='data:blog.homepageUrl' style='display: block'>
          <img expr:alt='data:title' expr:height='data:height' 
expr:id='data:widget.instanceId + "_headerimg"' 
expr:src='data:sourceUrl' expr:width='data:width' style='display: block'/>
          </a></h1>

Anyone please help me about this matter. :(
