Bug with Labels when posting with API v3

I use .NET Api V3 and last week i have some problem with posting content with new labels. Simply i can't post new content with new labels. Atm my blog has arround 2k unique labels and as i know the limit is 5k. So, any idea? api is broken? what is wrong...
