Okay. I'll see what I can work out. Related to this, you said:

I don't understand what you mean. Should I create a new option, or 
change the behaviour of xml tidying to be more correct in general?

Yes. The idea is that if a libxml2 parse fails I can fall back on tidy. 
In both cases I'm building my own tree afterwards, so I don't use any 
of tidy's pretty printing options (I set tabs, etc to zero where the 
option exists).
