Sec. 53-41. Excess collections; failure to remit collections. If any vendor shall, during any reporting period, collect as a tax an amount in excess of the amount set forth in section 53-28 of this article during the reporting period, he shall return and pay over to the manager the full amount of the tax herein levied and also such excess. The retention by the retailer of any excess of tax collections over the aforesaid rate or the intentional failure to remit punctually to the manager the full amount required to be remitted by the provisions of this article shall be a violation of this article. (Ord. No. 666-81, § 1, 12-14-81; Ord. No. 490-87, § 1, 8-31-87)
I read that to say you can collect the tax form anyone in the state at the same level, as long as you send the overpayment to the manager (not to the customer). If you read the beginning of the document the manager very likely refers to the taxation authority the tax is paid to. If you collect the maximum set out in the state you're covered. They just don't want you to overcharge for tax and pocket the difference yourself, they'll be happy to take it off your hands! And you can clearly state the amount of tax collected in a line item that the customer can see, if they don't agree, they cancel the transaction at worst, or call you to find out why it's not what they think it should be and you explain why.
