However, you would open yourself up to being sued for illegally distributing the software if discovered.  When you lost, you would have to pay damages of at least your revenues from the sales.  Would the risk really be worth it?

It is far more sensible to embrace the osCommerce name and take advantage of it.  Tell people that you are selling your expertise in configuring and modding software that has a support organization, rather than (falsely) claiming to have written your own.
