Clarification of the use of 'osCommerce'

Sorry if this is the wrong forum or if it has been recently covered, but I can't see reference to it anywhere...

It would be most helpfull if HPDL and/or the core team made a statement regarding the use of the word 'oscommerce'.

Is this a registered trade mark? If not what, if any, guidelines, rules or laws apply, if any, internationally, to its use.

I know of two sites, set up to help users of oscommerce, that undertandably used 'oscommerce' in their domain name. In both cases, oscommerce attempted to have the sites shut down. Hosting companies are jumpy these days and seem to shut down sites without hesitation at the first complaint, whether justified or not.

Clarification would help a lot and save those wishing to promote your excellent system much trouble, not to mention money.
