It's a academic question really.

It shouldn't really be an 'error'....warning maybe...but it does make log=
ical sense to allow it.

I think the "problem" is in the framework...I was just wondering if there=
 was some option somewhere that could turn the error off, and allow it.

VB.net and F# didn't work either.
