Thanks for the quick reply Charlie.

I played around with this for a while yesterday and I think I proved
that log4net and the assembly attribute wasn't seeing, whether
it checked or not I could not know, my config file. When I 
manually used the XmlConfigurator it starts working. I'm not
sure how the implementation of response to the assembly attribute
works but, I'm suspecting that since Nunit.exe is the running assembly
and not the .dll being tested, this has something to do with it.
