Good question! I thought pretty hard about that.

One thing that becomes apparent when you try to implement the BICC
scheme is that it's actually really hard to audit all of your data and
make a determination about the publication status of the data. So I need
to leave in the possibility of "no comment" on the publication status
because it might not always be known.

If I used red for unknown you could have situations where data that is
actually private is marked as red because it hasn't been audited
properly yet.

Also, most sites don't implement the BICC scheme and use white
backgrounds. So in a sense they are compatible.

I was a little bit concerned at first that this scheme might end up
butchering the UI and making it look like a ransom note, but I've been
pleasantly surprised by the results. They actually look pretty good. The
colour adds a nice dimension. Here's an early example:
