shrink-wrapped?  that's really out-dated.  look at the 'upgrade' downloads 
that
most software comes with and you will see that for you to get them you must 
agree to their terms.
allot of software companies,  and many hardware ones, do updates to their 
software not by
physical antiquated shrink-wrap but downloads with terms, and 
you're  saying that they are all invalid?
or that's okay because it's binary only?

so either you're advocating a binary-only solution or you haven't thought 
this out.

requiring a physical imprimatur, like a hard cardboard box,  would 
invalidate most
of the web and hence future technology.  it is really quite passe.  that's 
why in the usa,
at least,  most of those stores have gone belly-up.  it's really not viable 
it's so expensive.
