I think that your main topic/issue is reuse of the GPL'ed code. I 
don't have J.D. in law, but I can clearly see that the FSF claims 
("GPL incompatibility", "combined works", "two classes of 
derivative works", etc.) are barred by the doctrine of copyright 
misuse and by the doctrine of first sale, just to begin with.
