Fees for extraordinary expenses

The clause in the Tsaba House is very much defined by failure on the  
part of the author. It is intended to allow the publisher to recoup  
unexpected extraordinary expenses related to a book's publication  
should the author fail to provide necessary materials as he or she  
asserted at the time the contract was made they would do.

Publishers set up a budget for each book they produce, and if they do  
more than one book a year unexpected costs can be a hardship.

For example, a book on butterflies would of necessity require an  
index. The author's original proposal, the one the publisher accepted,  
stated the author would provide that index. However, as the time of  
publication approaches no index is forthcoming, and the author tells  
the publisher he/she isn't going to provide it after all.

The clause in the contract allows the publisher to hire an indexer  
then recoup some or all of the cost of that indexer from the author.  
As several people have noted, it's rarely called into play for  
something like an index, which is a relatively minor expense in the  
overall scheme of things. However, consider if that author had  
promised not only an index but illustrations and/or photographs  
without which the book becomes all but useless--and fails to come  
through. The publisher has already invested a fair amount of money in  
the preparation of the manuscript. Advance copies of the galley may  
have gone out and been reviewed. It may make more sense for the  
publisher to hire the illustrations/photos done than to abandon the  
project.

All the clause does is allow the publisher to share or be repaid those  
costs should they so choose. IT IS NOT AND NEVER HAS BEEN A "FEE."
