I was discussing this on another list, and my thoughts were that Amazon and
the publisher have given themselves serious black eyes here, and they didn't
have to.

I can see why they would recall them, in an academic sense, but most
retailers wouldn't be able to in e-publishing...in most publishing, but I'll
get back to that. They can take the backup copy off of someone's bookshelf
(if there is a bookshelf), but they can't call them back, if they've been
downloaded at FW. You've downloaded it; you have it in hand.

Worse, the publisher, Amazon...and if it was anyone BUT Orwell, the author
as well...would probably take/have already taken a black eye for something
that isn't their fault, per se. Sometimes, it's better to (in the name of
good will and the physical impossibility of collecting them again) concede
the loss to the ultimate buyers of those copies and go after the pirate for
losses. Then bring the hammer down on the pirate.

To use an example or two. Case study time.

If the case against Booksurge (the one where the family claimed they'd
stolen the idea for their POD tech from someone who'd tried to sell it to
them) went against BS, they wouldn't have recalled books made with it. They
would have paid a settlement and then a percentage of future books made with
the tech to the family. The only real problem for ultimate consumers would
have been in a small increase of future books purchased, both in the
additional percentage to the winner factored into new prints and BS padding
the price to recoup their court losses.

If someone uses a photo he/she doesn't have rights to use in a publication,
the author (or in the case of magazines and like ventures, the publisher) is
liable. Readers who purchased the magazine in question do not have to turn
their copies in or be sued.

FWIW, I dislike any system that doesn't let me download my book copies onto
my local hard drive and back them up. It's not just this sort of problem
with pulling back/deleting books from my machine. It's also the problems of
things like their system going belly up and taking my files with them. One
of the reasons I refuse to own a Kindle, unfortunately.
