The publisher didn't upload the copies, that's why they were yanked.  
(I'm not sure about this, but I THINK it was a pirate.)

Not analogous. Barring the notes that the high school student made, no  
one's alleging that Amazon took anything made with the stolen copies.

Only if the complainants CHOSE to allow it. They would have paid  
regardless, but they wouldn't necessarily get to continue using it.
