Simply put, I've spoken to authors overseas whose opinion it is that:
"That's not MY law." I even had one German author comment that she felt
Germany was "maneuvered" into signing Berne, in the first place, and saw no
reason to follow it, as a result. If the whole Hegemann case is any
indication, the German sensibilities, in general, are looser about
"borrowing" from other authors (even if the author is borrowing entire pages
of text and using them in the same context) than the US senisibilities are.
Or maybe not and the press is just playing up a bunch of barking idiots
giving their two cents on the issue.

Then there is the example of the person who put 1984 on Amazon and started
that mess. From his/her POV, their laws say it was public domain, but they
weren't looking at the laws of the home country. The book wasn't published
there, was it? (Rhetorical, of course.) It was subject to the laws of the
publishing country.

I won't say US is completely innocent. A lot of people don't know the
original Peter Pan stories, for instance, have been deeded to the children's
hospital and remain under copyright. Since even UK law would indicate it's
public domain now, they think they are safe with it. And there is the case
of Tolkein's rights being trampled in the US.

But more often, I find the opposite...people outside the US who don't
consider US law and the Berne.
