DOJ applied the wrong law

[Here is a challenge to the DoJ to prove its statements, as well as 
raising the question about the market differences between ebooks and 
physical ones. Previously the Judge has been restrictive on the attempts 
of defenders to make their points fully. But Kohn's arguments look 
fundamental to the issue under examination and need a full airing. Links
