pallante - comprehensive review

I have completely revised my first knee-jerk reaction to this speech 
(precursor to evidence to Congress) by Maria Pallante: THE NEXT GREAT 
COPYRIGHT ACT Twenty-Sixth Horace S. Manges Lecture by Maria A. Pallante .

I now see she has an excellent grasp of the issues, an impressively 
balanced view, and a comprehensive understanding of the needs of new 
legislation. The sense of co-ordinated thinking comes strongly across. 
The footnotes and her speech provide something close to a course in the 
past, present and potential future of copyright in the US.

For me, as a non-American, there is something else. She may be the only 
person anywhere with the stature to influence the next big move in 
copyright; the copyright of the 21st century. Not everything would be 
relevant to the rest of the world, but in the main I see a person who 
could lead a great leap of thinking for copyright in the digital age. A 
world leader in how to do it.

Take 20 minutes and read this. If you see an area you want to influence 
send in well thought views. The footnotes point to almost any 
information you might need.

As a teaser I put below three quotations she has used and two of her own 
words. Read it and think about it. This is your future.

Joseph Harris

“the Framers intended copyright itself to be the engine of free 
expression.â€65

“copyright law reads like the tax code, and there are sections that are 
incomprehensible to most people and difficult to me.â€111

“[t]he immediate effect of our copyright law is to secure a fair return 
for an ‘author’s’ creative labor. But the ultimate aim is, by this 
incentive, to stimulate artistic creativity for the general public good.â€117

The expertise of the Office is reflected in countless contributions over 
the last hundred years, including official studies, congressional 
hearings, treaty negotiations, trade agreements, policy recommendations, 
and legal interpretations, not to mention in the Copyright Act and its 
legislative history and in opinions of the courts.

In closing, I would like to encourage Congress not only to think about 
copyright law but to think big. The next great copyright act is as 
exciting as it is possible. Most importantly, it is a matter of public 
interest.
