I agree Chris. After what happened with Wiley recently, any ruling is 
possible. What I was taken by was the line of reasoning and the lay out 
of how matters have been interpretted so far. Note the reference to a 
view in Congress; a court has to be very sure of  its ground to ignore 
that. Even more than the outcome, the understanding of file transfer, 
and of electronic detail impressed me; a lot of non-legal stuff I've 
come across gave me the impression that courts had been moving in a 
different direction.

While I know know  a fair bit about copyright, I don't have, and never 
had, enough time to study everything. So I'm always learning more, 
particularly about the US positions. I'd long thought the logic had to 
go the way of this determination, so I feel very pleased to see this. 
Together with the moves now to write a new Act in the US I am more 
confident that the outcome will be supportive of the continuation of 
strong copyright.

In turn, it may be that the existence of the internet alone has vastly 
increased the ability to "contribute to culture", and that further 
inroads into availability could become counter-productive. From a wide 
and long-term perspective I don't see a thriving industry operating at 
lower prices than those in use now. That is why I was very disappointed 
at the Wiley outcome; it seemed to me to harm copyright law, contract 
law and mistakenly think price the only aspect of consumer best interest.
