I really do think they're more right than not to say so. They're not
scanning the books to use them as books, they're scanning them to use
them as search metadata, and without that kind of massive scanning and
indexing you couldn't have that kind of book search.

Copying stuff is what search engines do. I recall hearing that Google
has somewhere between four and six complete copies of the entire
Internet on its own servers, and that's what it runs its searches on.
Yet nobody seems to be objecting to THAT particular massive copyright
violation...
